Heard Mr. Lalatendu Samantaray, learned
counsel appearing for the appellant-petitioner, Mr.
D.P. Dhal, learned Senior Advocate along with Mr.
Haripad Mohanty, learned counsel appearing for the
informant and Mr. Jateswar Nayak, learned counsel
appearing for the Respondent- State.
The appellant-Sk. Jaffir @ Sk. Sariff has been
convicted under sections 147/148/302/149 of the
Indian Penal Code and under Sections 3 & 4 of the
Explosive Substances Act, 1908 and sentenced to
undergo imprisonment for life and to pay fine of
Rs.10,000/- (Rupees ten thousand), in default, to
undergo R.I. for one year for the offences punishable
under Sections 302/149 of the Indian Penal Code and
to undergo R.I. for six months and to pay fine of
Rs.1,000/- (Rupees one thousand), in default, to
undergo R.I. for one month for the offence punishable
under Section 147 of the Indian Penal Code, to
undergo R.I. for six months and to pay fine of
Rs.1,000/- (Rupees one thousand), in default, to
undergo R.I. for one month for the offence under
Section 148 of the Indian Penal Code, to undergo R.I.
for ten years and to pay fine of Rs.5,000/- (Rupees
five thousand), in default, to suffer R.I. for six months
for the offence under Section 3 of the Explosive
Substances Act, 1908 and to undergo R.I. for seven
years and to pay fine of Rs.5,000/- (Rupees five
thousand), in default, to undergo R.I. for six months
for the offence under Section 4 of the Explosive
Substances Act, 1908 by the learned Sessions Judge,
Ganjam, Berhampur in Sessions Trial No.19 of 2014.
