This complaint is for the offence
punishable under Sec.138 of the Negotiable
Instruments Act .

2. The germane facts necessary to
adjudicate this case are as follows:
The complainant and the accused are related to
each other. The accused borrowed Rs.48 lakhs
from the complainant, promising to repay the
amount with interest at a rate of 16% p.a. While
the accused has repaid a significant portion of the
borrowed amount, an outstanding balance of
Rs.20 lakhs remains unpaid. In discharge of this
legally recoverable debt the accused issued
cheque bearing No.792973 dated 07.02.2020 for
a sum of Rs.20,00,000/- drawn on Syndicate
Bank, Sarjapur.
