1. Case called out.Despite notice, as appears from Annexure No. CA-1 to the counter affidavit of State, no one appeared on behalf of thecomplainant/opposite party No. 2 to oppose the instant appeal.
2. Considering the aforesaid and also the previous orders of the Court including the order dated 17.02.2025, which says “in case learned counsel for the complainant fails to assist the Court, the bail application shall be decided finally on the next date of listing”, this Court proceeded to decide the instant appeal seeking bail finally.
3. Heard learned counsel for the appellant and learned AGA for the State of U.P. and perused the records.
4. The present appeal has been filed under Section 14-A (2) of Scheduled Castes and Scheduled Tribes Act, 1989 against the impugned order dated 04.05.2024 passed by Special Judge, SC/ST Act, Lucknow in Bail Application No. 2868 of 2024 arising out of Case Crime No. 493 of 2022, under Sections- 306, 201 I.P.C. and Section- 3(2)(V) of SC/ST Act, P.S.- Mohanlalganj, District- Lucknow.
