Heard Mr. R. War, learned counsel for the petitioner who has submitted
that this petition has been filed by the mother of the accused person who was
arrested in connection with Amlarem P.S. Case No. 09(10) 2022 under Section
5(m)(n)
/6 of POCSO Act.

Since the date of his arrest on 21.10.2022, the accused person was in
custody. In the meantime, charge sheet has been filed and the trial has
proceeded before the court of the learned Special Judge (POCSO), West Jaintia
Hills District, Jowai, the case being registered as Special POCSO Case No. 27
of 2022.

It is also the submission of the learned counsel that 13 out of 17 witnesses
have been examined so far, however, it is not likely that the trial will conclude
in a short span of time and considering the fact that the accused person is in
custody for a very long period of time, on this ground alone, the learned counsel
has made a prayer for grant of bail.

Mr. K. Khan, learned P.P has entered appearance on behalf of the State
respondent No. 1. The learned P.P has submitted that since the complainant has
been arrayed as party respondent herein, the petitioner may be directed to take
steps for issuance of notice upon the complainant before further proceeding
with the matter.

Accordingly, in the first instance, the petitioner is directed to take steps
for issuance of notice upon the said respondent No. 2/complainant. The
prosecution is to ensure that the IO takes necessary steps and to file the
affidavit-of-service before this Court on the next date fixed.

List this matter on 11.07.2025.
