Heard the parties.
2. This anticipatory bail application under Section 438 of the
Code of Criminal Procedure, has been preferred by the
petitioners apprehending their arrest for offences registered
under Sections 341, 323, 326, 307, 504, 506/34 of the Indian
Penal Code in connection with Maheshpur PS Case No. 140 of
2023 pending in the CJM, Pakur.
3. There is an allegation that the petitioners and others
assaulted the deceased who later on was taken to the hospital,
where he died.
4. Learned A.P.P. representing the State opposes the prayer
for anticipatory bail.
5. Since there is an allegation of assault by these petitioners
on the deceased, I am not inclined to grant anticipatory bail to
these petitioners, accordingly, this anticipatory bail application
is dismissed.
