1. This is a claim for compensation arising out of the
Detailed Accident Report filed u/s 158(6) Motor Vehicle Act,
qua petitioner namely Sonu for the injuries suffered by him in a
vehicular accident which occurred on 28.09.2020 with respect to
which FIR No. 380/20 was registered at Police Station Fatehpur
Beri against R-1 Shailender, driver of the offending vehicle
which was owned by respondent no. 2 Mr. Ganesh Nath, used by
respondent no. 2A/ Raj Kumar and insured with respondent no.
3/Future Generali India Insurance Company Ltd.
2. The IO has filed copies of the criminal proceedings
including FIR and the charge-sheet in the DAR.
3. Brief facts of the vehicular accident as averred in the
DAR and the claim petition are that on 28.09.2020 at about 11.30
PM, the petitioner Sonu was going towards CDR Chowk on
motorcycle bearing no. DL-3SCR-3356 with due care and at a
normal speed. When he reached near Gate of Western DLF,
Chattarpur Farm, New Delhi, suddenly an auto bearing no.
DL-1RL-1812 being driven by its driver in a rash and negligent
manner came towards him and hit his motorcycle on the front
side. Due to this impact, he fell down on the road and sustained
Sonu vs. Shailender Kumar and ors.
