Heard learned counsel for the petitioner and learned

Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with

Roh P.S. Case No. 177 of 2024 registered for the offences under

Sections 419, 420, 467, 468, 471, 120(B) and 34 of the Indian

Penal Code and Sections 66(C) and 66(D) of the Information

Technology Act.

3. As per the prosecution case, the police got secret

information that the accused persons are indulged into

scamming people through phone on false assurance of job. It is

alleged that on seeing the police party, the accused persons

started to flee, however, one person namely, Pawan Kumar was

apprehended and the others managed to escape. It is further

alleged that the said apprehended accused person disclosed the

name of the petitioner and others.

4. Learned counsel for the petitioner submits that the

petitioner has not committed any offence and has falsely been

implicated in this case. It has been further submitted that the

name of the petitioner has surfaced on the confessional

statement of the apprehended co-accused person and it has lastly

been submitted that the other similarly situated co-accused

persons namely, Vicky Kumar @ Bikky Kumar, Raghunandan

Kumar @ Raghunandan, Sintu Kumar and Sonu Kumar have

already been granted anticipatory bail by Co-ordinate Bench of

this Hon’ble Court vide order dated 11.09.2024 passed in Cr.

Misc. No. 58980 of 2024. It has been submitted that the

petitioner carries one criminal antecedent and he is in custody

since 18.03.2025.

5. Learned APP for the State has vehemently opposed

the prayer for bail of the petitioner and has stated that the

petitioner forms a gang who are involved in duping innocent

persons.

6. Considering the aforesaid submissions made by the

parties and taking into account the fact that the similarly situated

co-accused persons have been granted bail, let the petitioner

above-named be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Rupees Ten Thousand) with two sureties of the like

amount each to the satisfaction of the learned Judicial

Magistrate-1st Class, Nawada in connection with Roh P.S. Case

No. 177 of 2024 subject to the conditions :-

(i) One of the bailors of the petitioner shall

be his close relative.

(ii) The petitioner shall remain physically

present in Court on each date of the trial.

(iii) In case of absence on two consecutive

dates or in violation of the terms of the bail,

the bail bond of the petitioner will be liable

to the cancelled by the court concerned.

(iv) The Court below shall verify the

criminal antecedent of the petitioner and in

case at any stage it is found that the

petitioner has concealed his criminal

antecedent, the court below shall take step

for cancellation of bail bond of the petitioner.

However, the acceptance of bail bonds in

terms of the afore-mentioned order shall not

be delayed for purpose of or in the name of

verification.
