The West Bengal National University of Juridical Sciences offers a compulsory course on Alternative Dispute Resolution (ADR) to the fourth-year students. In furtherance of the same, Mr. Anirudh Krishan Gandhi, Partner Designate, Saraf and Partners, New Delhi, was invited to interact with the students and discuss nuances of the practice of arbitration. To briefly introduce Mr. Gandhi, he completed his graduation from National Law University, Delhi in 2014 and subsequently, he also pursued the prestigious LL.M. programme in MIDS, Geneva in 2021-2022. The interactive session was aimed at giving the students an avenue to explore pertinent issues in arbitration and pique their interest in this field.
The sessions were broadly divided into three segments. The first segment delved into the essentials that must be kept in mind while drafting an arbitration agreement. Mr. Gandhi also held a Practical Workshop to help students understand the practicalities and nuances involved in the drafting of an arbitration agreement. The second segment of the session focussed on the laws governing an arbitration agreement. The last segment was dedicated to understanding the current judicial trends by means of a comparative analysis highlighting the position taken by various jurisdictions on matters pertaining to law governing arbitration agreement and manners of enforcing an arbitration agreement. The sessions helped the students learn about the various practical nuances.
