2. This is an appeal against acquittal, filed by
State under Section 419(3) of B.N.S.S.
3. By impugned judgment dated 30.04.2024,
passed by Additional Sessions Judge/FTSC,
Rudrapur, District Udham Singh Nagar in Special
Sessions Trial No. 361 of 2022, respondent was
acquitted of the charge of offences punishable
under Sections 363, 366 and 376(3) IPC and
Section 6 of POCSO Act.
4. There is delay of 144 days in filing the
appeal.
5. Issue notice to respondent on Delay
Condonation Application (IA/1/2024), as well as
Leave to Appeal Application, returnable within six
weeks. Steps to be taken within one week.
6. List this case on 27.02.2025.
