The complainant has filed this complaint Under

Section 200 of Cr.P.C against the accused alleging that

the accused has committed an offence punishable Under

Sec.138 of the Negotiable Instruments Act, 1881. (In

short N.I.Act).

2. The brief facts of the complainant’s case are

as under :

It is the case of the complainant that,the

complainant is registered finance Company having its

Corporate Office at No.66, Arcot Road, Kodambakam,

Chennai-6000024 and having one of its branch at

Shivajinagar, Bangalore, being a legal entity and it has

right to recover the money due from the subscribers and

the guarantors. Further, in the course of chit business,

accused subscribed the chit group bearing

No.G2G/0083/MSR/18 carried by complainant for a chit

group for a sum of Rs.3,00,000/-. After bidding the

above said chit, accused become a defaulter. Inspite of

repeated requests and demands made by the

complainant for repayment of the chit installment

amount due by accused, accused issued cheque bearing

No.381368 for Rs.3,57,742/- dated 06.03.2020 drawn on

State Bank of India, Shivaji Nagar Branch, Bengaluru.
