This case has arisen as a result of the
complainant filing a complaint against the accused
under Section 138 of the Negotiable Instruments
Act.

2. The relevant facts required to adjudicate
this case are as follows:
The accused was introduced by the
complainant by one Nagesh and there after the
accused was in constant touch with the
complainant and became a friend. In the month of
February 2018, the accused sought a hand loan of
Rs.10 lakhs from the complainant. The accused was
having the knowledge that the wife of the
complainant had received her terminal benefits and
PF from her employer, HP Global Soft Ltd. The
accused sought this amount to establish a poultry
hatchery and promised to repay it within 4 months.
