The Investigating Officer, Sri Pramod Kumar P., the Inspector of
Police, Sringeri police station, has submitted a charge sheet against
the accused persons for offences punishable under Sections 143,
144, 147, 148, 384, 448, 121 read with Section 149 of the Indian
Penal Code, 1860 (hereinafter referred to as ‘IPC’), Sections 3 and
25 of the Indian Arms Act, 1959 (hereinafter referred to as ‘the Arms
Act’), and Section 13 of the Unlawful Activities (Prevention) Act,
1967 (hereinafter referred to as ‘the U.A.(P) Act’).
2. The brief facts of the prosecution’s case are as follows:
(a) On 28.02.2014, around 8:00 p.m., while PW.1, Sri T.S.
Anand Rao, was at his house, Mundagaru Latha and others came to
his house and called him outside. When he came outside, he saw
two men and two women, all wearing green-colored dresses and
armed with guns. They introduced themselves as Naxals and
explained that they had fought against the eviction of people from
Kuduremukha National Park. They solicited his support to fight
against issues related to encroachment and other matters. They
asked PW.1 to provide his mobile phone, stating that they needed to
speak with press reporters. When PW.1 suggested they make calls
from a landline, they insisted that they needed to speak with the
reporters for hours and would do so on top of the hill. With no
alternative, PW.1 told his son to hand over his black Nokia mobile
phone (with a BSNL SIM card bearing the number 9483984037), but
they did not return it. As a result, he lodged a First Information
Statement with the police. PW.9, Sri K.V. Rajashekhar, visited
PW.1’s house, received the First Information Statement, returned to

the police station, and registered a case against the accused for
offences under Sections 384, 121 read with Section 34 of the IPC,
Sections 3 and 25 of the Arms Act, and Section 13 of the U.A.(P) Act,
and took up the case for investigation.
