The Investigating Officer, Sri Abdul Ahad, the Deputy
Superintendent of Police, has submitted a charge-sheet against
accused Nos. 6, 8, and other accused persons for offences

punishable under Sections 143, 147, 148, 323, 435, 341, 506, 302,
and 396 read with 149 of the Indian Penal Code, 1860 (hereinafter
referred to as ‘IPC’), Sections 3 and 25 of the Indian Arms Act, 1959
(hereinafter referred to as ‘Arms Act’), and Sections 13, 16(1)(a), and
18 of the Unlawful Activities (Prevention) Act, 1967 (hereinafter
referred to as ‘U.A. (P) Act’).
2. The brief facts of the prosecution case are as follows:
(a) The first informant, CW.1, Smt. Madhura, her deceased
husband Sri K.G. Venkatesh, and her son PW.3, Sri Anudeep, were
residents of Gandagatta village, Kigga Hobli, Sringeri Taluk. The
deceased, Sri K.G. Venkatesh, was running a grocery shop in the
front portion of his house. On 03.06.2007, at around 07:45 p.m.,
when CW.1, Smt. Madhura, her husband, and her son were in the
shop, four unknown persons came from Kigga Road and called the
deceased, Sri K.G. Venkatesh, outside the shop. Three persons
entered the shop, began assaulting the deceased, and disconnected
the telephone line. They forcibly snatched biscuit packets, juice
bottles, grocery items, cash amounting to Rs. 6,000/- to Rs. 7,000/-,
and a Nokia mobile phone with a SIM card worth Rs. 3,000/-. They
dragged the deceased, Sri K.G. Venkatesh, outside the shop and
assaulted him indiscriminately. When CW.1, Smt. Madhura,
requested them not to assault her husband, they threatened her at
gunpoint and instructed her to remain silent. CW.1, Smt. Madhura,
frightened, complied. Of the four persons, three fired at the head and
chest of the deceased, Sri K.G. Venkatesh, and assaulted him with a
sword on his chest, under the instructions of another person wearing
a gray-colored shirt and lungi. The deceased, Sri K.G. Venkatesh,

died at the spot. The assailants then threw pamphlets containing
Naxal literature inside the shop and near the deceased’s body. One
of them poured petrol on the Hero Honda motorcycle of the
deceased, which was parked in front of the shop, and set it on fire.
