The State has filed this petition u/s 439(2) of the Code of Criminal Procedure for

cancellation of the bail granted to accused/respondents.

By order dated 29.01.2022 passed in Special Criminal Case No.48/2022 by the Court

of the learned Special Judge (NDPS) Act, Korea, Baikunthpur, respondents were granted bail

in Crime No.37/2022 registered at P.S. Chirimiri, District Korea (Now Manendragarh-

Chirimiri-Bharatpur) for the offence u/s 20(b)(ii)(B) of the NDPS Act, 1985.

It appears that the petitioner has directly approached this Court for cancellation of

bail without filing any application before the trial Court where the bail was granted to the

accused/respondents.

Learned counsel for the petitioner prays for withdrawal of this petition with liberty to

file appropriate application before the appropriate Court.

As prayed, this petition is dismissed as withdrawn with the aforesaid liberty.
