When the matter is called out, learned APP Mr. Pranav
Dhagat for the appellant State submits a report of the Police
Inspector, Dholka Town Police Station stating that the
respondent no. 1 – Arvindbhai Kanubhai Devipujak has
expired on 16.09.2015. Along with the report of Police
Inspector, Dholka Town Police Station, a certificate of
Sarpanch, Khatripur Gram Panchayat, Taluka Dholka,
District Ahmedabad is also produced on record stating that
the respondent no. 1 – Arvindbhai Kanubhai Devipujak
resident of village Khatripur has expired on 16.09.2015. The
report along with the certificate of Talati Cum Mantri is
taken on record.

On perusal of the record, bailable warrants were
issued to the respondents by an order dated 30.04.2013
and the warrant qua the respondent no. 2 had returned
unserved as the respondent no. 2 had expired on
01.06.2013. The copy of the death certificate of the Talati
Cum Mantri, Khatripur Gram Panchayat, Taluka Dholka,
District Ahmedabad is on record which shows that the
respondent no. 2 – Rohitbhai Manubhai Devipujak has
expired on 01.06.2013.
In view of the above, as both the respondents have
expired, the appeal is disposed off as infructuous.
