we are inclined to condone the delay in filing the restoration

5. Taking into consideration the cause shown in the restoration

application, we are inclined to allow restoration application.

6. Accordingly, restoration application is allowed and D.B.

Special Appeal (Writ) No.1046/2023 is restored to its original

number.
