1. Heard Sri Anuj Kumar Mishra, learned AGA appearing for the appellant-State of UP and perused the record.

2. Present government appeal has been preferred against the judgement and order dated 26.11.2021 passed by the Special Judge (POCSO Act)/Additional Sessions Judge, Bulandshahar in Special Criminal Case No.-25 of 2014 (State of U.P. Vs. Sonu), arising out of Case Crimes No.- 109/771 of 2013 under Sections 363, 366, 376 IPC and Section 4 of POCSO Act, PS- Kotwali Dehat, District- Bulandshahar.

3. Prosecution story, in brief, is that the daughter of complainant was missing and in this regard he had given ‘tehrir’ stating therein that on 20.12.2013 at 11:00 A.M. Sonu, who is brother -in-law of Suresh has enticed her daughter away. Her daughter is aged about 17 years. He tried to search her. He got to know from villagers that Sonu has enticed her away. The first information report has been lodged upon his ‘tehrir’.
