All the aforesaid criminal appeals have arisen out of the
common judgment dated 15.04.1996, passed by learned Special
Judge, SC/ST (Prevention of Atrocities Cases), Jodhpur, in Session
Case No. 84/1995 by which the learned Trial Court acquitted the
accused namely Chain Singh, Sultan Khan and Babu Khan from
offence under Sections 147, 447, 148, 341, 302/149 IPC and
Sections 3(1)(5), 3(2)(5) of SC/ST Act and; convicted and
sentenced the rest of the accused persons as under :

All the sentences were ordered to run concurrently.
Criminal Appeals No.262/1996 & No.266/1996 have been
preferred by the accused against their conviction for the aforesaid
offences.
Whereas, Criminal Appeal No.486/1996 has been preferred
by the State against the acquittal of the accused persons for the
aforesaid offences.
Brief facts necessary to be noted for deciding the controversy
are that on 04.08.1995, complainant- Fakira Ram, gave a written
report at Police Station- Mathania to the effect that nearly 13
years ago, he was allotted agricultural land in Khasra No.939 in
the village Jellu, District Jodhpur. On 04.08.1995, when he was
engaged in cultivating the aforesaid land with two tractors, which
Budha Ram and Siya Ram were operating. At that time, villagers
arrived at the scene and forcibly obstructed him from continuing
his work. Thereafter, the complainant returned to his house. A few
hours later, while the complainant was traveling to Gagari on a
motorcycle accompanied by Siya Ram, they were stopped by
villagers, including the accused persons. During this encounter,
the villagers assaulted Siya Ram with lathis, using caste-based
slurs in the process. As a result of the assault, Siya Ram collapsed
and lost consciousness. The complainant managed to flee from the
scene and proceeded to the police station to report the incident.
On the said report, Police registered the FIR No. 92/1995
against the accused persons for offences under Sections 147, 148,
149, 323, 341, 447 IPC and Section 3(1)(v)(x) of SC/ST Act and
started investigation. Later on, offence under Section 302 IPC and
Section 3(2)(5) of SC/ST Act were added by the Police. On

accused persons.
Thereafter, learned Trial Court framed, read over and
explained the charges for the aforesaid offences to the accused
persons. They denied the charge and sought trial.
During the course of trial, the prosecution examined as many
as fourteen witnesses and also got exhibited relevant documents
in support of its case.
The accused persons were examined under Section 313
Cr.P.C., and in defence, three witnesses were examined.
Learned trial Court, after hearing the arguments from both
the sides, taking into consideration and appreciating the
documentary evidence and the statements of witnesses, vide
judgment dated 15.04.1996 acquitted the accused persons Chain
Singh, Sultan Khan and Babu Khan from offence under Sections
147, 447, 148, 341, 302/149 IPC and Sections 3(1)(5), 3(2)(5) of
SC/ST Act, however, convicted and sentenced the accused persons
namely Guman Singh, Shiv Singh, Raju Singh, Jalam Singh, Jethu
Singh S/o Rughnath Singh, Jethu Singh S/o Kalyan Singh, Narpat
Singh, Jor Singh, Heer Singh & Dhanna Ram for the offences as
mentioned above.
Hence, these criminal appeals, two by the accused persons
challenging their conviction, and one by the State challenging the
acquittal of three accused persons mentioned above.
Criminal appeal No.262/1996 qua accused-appellant No.3
Raju Singh had already been dismissed as abated vide order dated
17.07.2003 by this Court.
It has been informed to this Court that during the pendency
of the criminal appeal No.262/1996, accused-appellants No.2 Shiv

Narpat Singh, have passed away. Hence, the criminal appeal
No.262/1996 is hereby dismissed qua the appellants No.2, 5, 7 &
8 is hereby dismissed as abated.
It has also been informed to this Court that during the
pendency of criminal appeal No.486/1996, accused-respondents
No.1- Chain Singh and No.2- Sultan Khan have passed away.
Hence, the criminal appeal No.486/1996 qua accused-respondents
No.1 & 2 is hereby dismissed as abated.
Learned counsel appearing for the accused persons has
vehemently submitted that the conviction recorded by the trial
court against the accused persons is per se illegal. It is further
submitted that in the FIR, the complainant- Fakira Ram, who was
the eyewitness of the incident, has merely stated that the accused
persons arrived and caused injuries to the deceased- Siya Ram by
lathi and the incident occurred at about 2:00 PM. However, the
written report was lodged approximately five hours later, at
around 7:00 PM, and FIR was registered only for offences under
Sections 341, 447, 149 IPC and Sections 3(1)(v)(x) of SC/ST Act.
Counsel further submits that according to the statement of PW/14
Chen Singh, the Investigating Officer, when he arrived at the place
of occurrence, the deceased- Siyaram, had already succumbed to
his injuries. Upon realizing this, the officer immediately relayed
the information to his superior, and upon receiving instructions,
the offences were accordingly amended to include Section 302 of
the IPC and Section 3(2)(v) of the SC/ST Act. It is also contended
that, before the submission of the written report by Fakira Ram
(PW/3) at approximately 7:00 PM, the police had already reached
the scene of the occurrence. Therefore, the FIR is essentially an

ante-dated document, and the complainant, Fakira Ram, did not
witness the incident firsthand. The counsel further argues that
Fakira Ram (PW/3) has falsely implicated the present accused
persons. Moreover, it is pointed out that all the eyewitnesses,
namely Fakira Ram (PW/3), Govindram (PW/4), Prahaladram (PW/
6), Ramuram (PW/7), and Siyaram (PW/8), have collectively made
omnibus allegations that the accused persons inflicted injuries
upon the deceased Siya Ram; these witnesses have named as
many as thirteen accused individuals. The counsel also refers to
the postmortem report of the deceased, Siya Ram, as well as the
statement of PW/13 Dr. BP Gehlot, which indicates that Siya Ram
had sustained only five injuries, two of which were on his head,
and that the cause of death was head injury. It is argued that,
based on the statements of the eyewitnesses and the doctor’s
testimony, it remains unclear who inflicted the head injury upon
the deceased. Furthermore, the counsel highlights significant
contradictions, improvements, and omissions in the testimonies of
the witnesses, which undermine the credibility of the prosecution’s
case. Consequently, the accused persons have been falsely
implicated. In light of the foregoing, the counsel submits that the
impugned conviction passed by the trial court is wholly illegal and
warrants quashing and setting aside. The accused persons are,
therefore, entitled to be acquitted of the charges.
Learned Public Prosecutor has vehemently opposed the
submissions advanced by the counsel for the accused persons and
has contended that all the eyewitnesses have explicitly testified
that the accused persons caused injuries to the deceased, Siya
Ram. Furthermore, a lathi (gedi) was recovered from the
possession of the accused individuals. Accordingly, the learned

trial court has rightly convicted the accused persons for the
offences in question. However, regarding three accused persons,
namely Chain Singh, Sultan Khan, and Babu Khan, the trial court
acquitted them on the ground that they were not named in the
FIR. The Public Prosecutor submits that, despite the availability of
substantial evidence on record, the trial court has committed a
serious error in acquitting these three accused individuals. Thus,
given the evidence, they also merit conviction for the
aforementioned offences.
We have given our thoughtful consideration to the arguments
advanced by learned counsel for the appellant, learned Public
Prosecutor, and meticulously examined the impugned judgment
alongwith material available on record.
In order to ascertain legality and propriety of the findings
and conclusion of the learned trial Court, it is necessary to re
appreciate the evidence adduced by the prosecution.
On perusal of the statements of the PW/3- Fakira Ram, the
complainant and brother in law of the deceased; PW/4- Govind
Ram, brother in law of complainant; PW/6- Prahlad Ram, son of
the complainant; PW/7- Ramu Ram, son of the complainant;
PW/8- Siya Ram, have stated that they were eyewitness to the
incident. They affirmed that at the time when the accused were
assaulting the deceased, they were present at the scene and
standing nearby, thereby witnessing the events firsthand. The

In the light of aforesaid prosecution witnesses, this court is
of the considered opinion that, firstly, all the alleged eyewitnesses
are either interested parties or related to the parties involved.
Secondly, their testimonies merely assert that they were in close
proximity to the incident, which raises significant doubts about
their credibility, especially considering the nature of the alleged
assault. It is implausible to believe that the accused would have
assaulted the deceased, a family member of the eyewitnesses and
that these witnesses would have failed to make any effort to
intervene or save him. Moreover, upon thorough examination of
the corroborative evidence, including the recovery of lathis
pursuant to information obtained under Section 27 of the Evidence
Act, it is evident that the investigation had not proceeded to send
the recovered items for forensic analysis by the Forensic Science
Laboratory (FSL). This omission underscores a critical deficiency in
the evidentiary process. It is well-established in criminal
jurisprudence that mere recovery of an object, in isolation, cannot
substantiate an accused’s guilt beyond a reasonable doubt without
independent corroboration or scientific validation. The absence of
such corroborative measures diminishes the probative value of the
recovery, rendering it insufficient to establish a direct link between
the accused and the commission of the alleged offence.
Consequently, the evidence presented fails to meet the requisite
standard of proof necessary for conviction, as it lacks the
substantive corroboration essential to establish guilt beyond a
reasonable doubt.

case. The genesis of the alleged occurrence appears dubious, as
the case rests heavily on interested witnesses and uncorroborated
evidence. Additionally, it appears that the prosecution has
suppressed material evidence and has failed to present the
complete factual narrative, thereby undermining the integrity of
the case.
In light of these considerations, the Court finds that the
prosecution has not sufficiently proved the guilt of the accused
beyond reasonable doubt. The inconsistencies, lack of independent
corroboration, and suppression of material facts collectively lead
to the conclusion that the case against the accused is not tenable
in law. Therefore, we are of the opinion that the learned trial court
has wrongly convicted the accused persons for the offence under
Sections 147, 447, 148, 341, 302/149 IPC and Sections 3(1)(5),
3(2)(5) of SC/ST Act.
In the result, the present criminal appeal No. 262/1996 and
criminal appeal No. 266/1996 are allowed. The conviction of the
accused appellant No.1- Guman Singh, No.4.- Jalam Singh, No.6-
Jethu Singh S/o Kalyan Singh, No.9- Heer Singh & accused-
appellant Dhannaram as recorded vide judgment dated
15.04.1996 passed by learned Special Judge, SC/ST (Prevention
of Atrocities Act Cases), Jodhpur, in Sessions Case No.84/1995 is
quashed and set aside. They are acquitted from offence under
Sections 147, 447, 148, 341, 302/149 IPC and Sections 3(1)(5),
3(2)(5) of SC/ST Act. They are on bail; they need not surrender.
Their bail bonds stand discharged accordingly.

The criminal appeal No.489/1996 preferred by the State is
hereby dismissed.
Record of the learned court below be sent back forthwith.
Keeping in view, however, the provisions of Section 437-A
Cr.P.C. the accused appellants are directed to forthwith furnish
personal bond in the sum of Rs.50,000/- each and a surety bond
in the like amount before the learned trial court within a period of
one month, which shall be effective for a period of six months to
the effect that in the event of filing of Special Leave Petition
against the judgment or for grant of leave, the appellants, on
receipt of notice thereof, shall appear before Hon’ble Supreme
Court.
