FACTUAL MATRIX
1. Briefly stated, the case of the prosecution against the accused is that on
13.03.2015 at about 03.00 PM in front of Reliance Fresh, Village
Hassanpur, Delhi-52, while the complainant Tarun was crossing the road
in front of Reliance Fresh, Village Hasanpur, Delhi, a truck/dumper
bearing registration No. HR 55J 5688 approached in a rash and negligent
manner and collided with his motorcycle, a Passion Pro bearing
registration No. DL 7 SAE 6303. As a result of the accident, his trousers
were torn. The driver of the truck allegedly ran the offending vehicle over
the witness’s leg twice, causing bleeding injuries. An auto-rickshaw was
standing behind the offending vehicle at the time of the incident and he
transported him to Max Hospital in his vehicle. As such, it is alleged that
the accused committed the offence under sections 279/337 of the Indian
Penal Code, 1860 (hereinafter, “IPC”) for which FIR No. 908/2015 was
registered at Police Station Madhu Vihar, Delhi.
