1. The present application under Section 419(4) of the Bharatiya
Nagarik Suraksha Sanhita, 20231 (corresponding to Section 378(4) of the
Code of Criminal Procedure, 19732), seeks leave to appeal against the
judgement of acquittal dated 24th June, 2024, passed by the Metropolitan
Magistrate, Tis Hazari District Courts, Delhi3, in Ct. C No. 8141/ 2019 titled
‘State v. Rafiq @ Morfiq’. The said direction arose from Compliant case
bearing no. CC No. 01/2019 registered against the Respondent under
Section 3 of the Railway Property (Unlawful Possession) Act, 19664, at P.S.
RPF/DEE.
