FACTUAL MATRIX
1. Briefly stated, the case of the prosecution against the accused is that on
18.12.2012 at about 01.30 PM, at opposite entery gate, ISBT Anand Vihar,
Road No. 56, Delhi, a person was seen walking along side grill on the other
side of the entry gate, on road no. 56, towards the prepaid booth and
suddenly a MCD truck bearing registration number DL-1GB-5380 being
driven in a in a rash and negligent manner came from the direction of
Seemapuri and hit the pedestrian from behind due to which fell on the road
and sustained injuries. The driver of the truck was apprehended, and his
name was revealed as Ramesh Kumar. Injured was taken to the hospital. As
such, it is alleged that the accused committed the offence under Sections
279/337 of the Indian Penal Code (hereinafter, “IPC”) for which FIR No.
447/2012 was registered at Police Station Madhu Vihar, Delhi.
