1. Accused Tara Chand is before the Court facing charge under
Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic
Substances Act, 1985 (in short “the NDPS Act”) as it is
alleged that 5.2 Kg Ganja (intermediate quantity) was
recovered from his possession on 28.06.2021.

2. In view of alleged recovery of 5.2 Kg Ganja from accused
Tara Chand, FIR No.295/21 was lodged at PS Seemapuri on
28.06.2021. After completion of investigation, charge-sheet
was filed on 27.08.2021. Charge was framed on 13.12.2021
for offence u/s.20(b)(ii)(B) NDPS Act, which reads as under :
