1. Brief facts of the case are that on 25-06-2014, at about
10:03 pm, an information was received at PS Karawal Nagar
through Wireless Operator that sister-in-law of the caller had
hanged herself at H. No. A-91, Gali no. 2, Harijan Basti, Karawal
Nagar, Delhi. The information was reduced into writing vide DD
no. 59B (Ex. PW6/A) and the same was marked to ASI Yogesh
Tyagi, (hereinafter referred to as first IO/Investigating Officer).
Thereafter, IO along with Ct. Balmesh visited the spot i.e. H. No.
A-91, Gali no. 2, Harijan Basti, Karawal Nagar, Delhi and
noticed that dead body of a lady was hanging by the grill of
ventilator. On inquiry, he came to know name of the lady as
Pooja w/o Vipin, aged 23 years old. She had given birth to one
child namely Shivam, who was only one year old. He
immediately passed on the information to Sh. Rakesh Sharma,
SDM Karawal Nagar. The Crime Team was called, which
inspected the spot and took photographs. The dead body of the
deceased was sent to GTB hospital through Ct. Balmesh.
Thereafter, ligature material i.e. rope, on which the deceased had
hanged herself, was seized vide seizure memo Ex. PW9/A. On
26-06-2014, the IO produced the father of deceased before SDM
concerned. Thereafter, the SDM recorded statement of father of
deceased namely Jaichand Singh, who claimed that he was
resident of Bhurepur Kalan, PS Ajitmal, Distt. Auraiya, UP. He
further stated that he has three children. One daughter is elder to
deceased Pooja and one son is younger to her. About two years
ago in the year 2012, he got his daughter Pooja married with
Vipin Singh as per Hindu rites and ceremonies. At the time of
marriage, the groom side had demanded dowry of Rs. 5 lakhs
cash and household articles, out of which, they had fulfilled the
demand of household articles and had given cash of Rs. 4 lakhs.
After the marriage, the relations of deceased Pooja and her in-
laws were not cordial and they used to demand further dowry of
Rs. 5 lakhs. Her in-laws used to commit torture upon her. On
25-06-2014, his eldest daughter, who too was residing in
Karawal Nagar called him and informed that Pooja had hanged
herself and she had died. He raised suspicion upon his son-in-
law Vipin, his brother Sandeep, his wife Rajni, mother-in-law
Ramwati, brother-in-law Nitin, brother-in-law Guddu and sister-
in-law Lalli for killing his daughter. On the basis of above-stated
statement, the present FIR came to be registered for the offence
punishable u/s 406/498A/304B/34 of IPC. Further investigation
was assigned to Inspector R. K. Jha. The IO prepared site plan.
He prepared inquest papers in the presence of SDM Karawal
Nagar. The postmortem of deceased was got conducted at GTB
hospital. After postmortem, the dead body was handed over to
the father of deceased. The postmortem report was received
wherein the cause of death was opined as asphyxia as a result of
antemortem hanging. On 30-06-2014, accused Vipin Kumar was
interrogated and arrested. His disclosure statement was recorded.
On 05-09-2014, further investigation was assigned to Inspector J.
S. Mehta. Co-accused Sandeep, Rajni, Ramwati and Nitin were
admitted to anticipatory bail and therefore, they were formally
arrested. On 19-09-2014, the IO got prepared scaled site plan of
the spot through the draftsman Inspector Mahesh Kumar. PCR
form was collected. Co-accused Mahesh Kumar and Vijaylaxmi
@ Lalli were interrogated. During interrogation, it transpired
that they had married about 12 years ago and they were residing
far way from the family of deceased. Therefore, they were not
arrested by the IO. The viscera of the deceased was got
deposited by the IO through Ct. Jaswant at FSL. The
photographs of the marriage of deceased and dowry articles were
collected. After completion of investigation, chargesheet was
filed against the accused Vipin Kumar, Sandeep Kumar, Nitin,
Rajni, Ramwati, Mahesh Kumar and Vijaylaxmi @ Lalli for the
offence punishable u/s 304B/406/498A/34 of IPC.
