Learned counsel for the appellant submits that the
arguing counsel Mr. Priyank Rathi is on adjustment till
25.04.2025 and prays for a short time to argue the matter.
As prayed, list this matter for final hearing in the
week commencing 28th April, 2025.

Vide order dated 21.11.2022, record of the trial
Court was summoned which has already been received
and kept with the file. Order-sheet of the trial Court
would show that last order has been passed on
21.12.2022. It is apparent that the trial has not progressed

for over two years and there is no stay order in the
present case. The appeal has been pending for about
three years and till date, final hearing in this case has not
taken place, therefore, I do not find it appropriate to
retain the records of trial Court any further.
In that view of the matter, Registry is directed to
sent back forthwith the record of the trial Court along
with the other two parts which are kept with the stamp
paper in the rack of the record room.
List this matter along with CR No. 35/2022.
