1. Mr.Tapas Chandra Pradhan, OPS ACP, Zone-III, Bhubaneswar –

UPD has appeared through virtual mode and submits that he has submitted

the status report in the office of the Advocate General. His personal

appearance is dispensed with.

2. Perused the report dated 11.12.2024 of the learned J.M.F.C. (Cog.

Taking)-V, Bhubaneswar wherein it is stated that preliminary charge sheet

has been submitted against the petitioner and he is in jail custody and

another accused-Rajkishore Behera has surrendered before this Court and

has been released on bail.

3. Perused the status report submitted by the Mr.Tapas Chandra

Pradhan, OPS ACP, Zone-III, Bhubaneswar UPD . It does not reveal that

any steps have been taken for arresting the absconding accused persons. It

is stated that during investigation, a prima facie evidence under Sections

452, 341, 324, 325, 307, 294, 380, 506, 120-B of IPC read with Section

25 of and 27 of the Arms Act and Section 3 (1) (r) (s)/2 (va) of S.C. and

S.T. (PoA) Act has been well established against the accused persons.

4. Ms.S.Moharana, learned Addl. Standing Counsel submits that up-

to-date case diary has not been received by her.

5. In view of above development, this bail application is not

maintainable and is disposed of as such.

6. It is open to the petitioner to file appropriate application for his

release on bail.
