2. Learned counsel appearing for the petitioner submitted that
the petitioner, a widow having lost her husband, approached this
Court challenging the transfer order dated 25.11.2024 passed by the
opposite party No.1 on the ground that the authority concerned has
not considered her application for transfer to a place nearby to her
native to enable her to take care of her ninety years old ailing
mother as none else is available in her family to look after her.
2.1. By virtue of Office Order dated 25.11.2024 under
Annexure-2, the petitioner was transferred from Jagatsinghpur to
Tirtol in the district of Jagatsinghpur, which is about twenty five
kilometres from the present place of posting and around one
hundred twenty five kilometres from her native place in Khordha.
Considering that her new place of posting would cause difficulty to
take care of her old mother, she has made representation to the

Department-opposite party No.1.
2.2. The petitioner seeks indulgence of this Court for a direction
to the said authority concerned for consideration of said
representation at the earliest.
3. At this stage, learned Additional Government Advocate
appearing for the State-opposite parties submitted that the petitioner
has, in the meantime, been relieved from her duties to enable her to
join at the new place of posting, i.e., Tirtol.
4. Considered the submissions made by the learned counsel for
the respective parties. As Sri Satyabrata Mohanty, learned
Additional Government Advocate appeared and waives issue of
notice, adequate numbers of writ petition be served on him in
course of the day.
4.1. However, considering the nature of grievance of the
petitioner, it is felt appropriate to observe that pendency of this writ
petition shall not be a bar for opposite party No.1 to consider the
representation vide Annexures-1 and 3 of the petitioner as stated to
have been pending before the said authority and dispose of the same
as expeditiously as possible preferably within a period of fifteen
days hence.
5. Registry is instructed to list this matter before the roster
Bench in the week commencing 20th January, 2025.
