By means of the present criminal revision, the
revisionist No.2 Kala S/o Shyama (Revisionist No.1 died
during the pendency of the revision petition on 13.06.2013) is
assailing the judgment and order dated 01.11.2013 passed by
learned 2nd Additional Sessions Judge, Haridwar in Criminal
Appeal No.164 of 2011, Sukked and another vs. State,
whereby, the learned 2nd Additional Sessions Judge, Haridwar
has rejected the criminal appeal and confirmed the judgment
and order dated 03.09.2011 passed by learned Judicial
Magistrate, Roorkee in Criminal Case No.423 of 2011, State
vs. Kala and three others, whereby the revisionist has been
convicted under Section 325 read with Section 34 IPC and
has been awarded a sentence of one year rigorous
imprisonment along with fine of Rs.1,000/- in default
stipulation one month additional imprisonment has also been
awarded to the accused persons.
