1. During the pendency of this appeal arising out of a final
decree, the co-sharers have agreed to settle their disputes
amicably and have filed a joint compromise petition
disclosing terms of settlement arrived at by and between
the parties in the meantime. The terms are lawful and
entered into by the parties with a view to put to an end to
the controversy amicably.
2. In view of such submission and the fact that the
settlement is in terms of Order 23 Rule 3 of the Code of
Civil Procedure, the suit is decreed in terms of the
compromise arrived at by and between the parties as fully
described and stated in paragraph 9 of the compromise
petition.
3. The department is directed to draw up a final decree in
terms of the settlement mentioned in paragraph 9 of the
compromise petition.
4. The appeal and the connected applications are,
accordingly, disposed of.

5. Urgent Photostat certified copy of this order, if applied
for, be supplied to the parties upon compliance of all
requisite formalities.
