1. Leave granted.
2. Heard learned counsel appearing for the appellant as
also the learned counsel appearing for the respondent-State.
3. The present appeal arises out of the impugned order
dated 21.10.2024, passed by the High Court of judicature at
Bombay, Nagpur Bench in Criminal Application (BA) No. 862 of
2024 whereby, the High Court has rejected the application
filed by the appellant seeking regular bail in connection
with the Crime No. 291/2023 registered at Police Station-
Gobwerwahi, Tehsil-Tumsar, District-Bhandara, Nagpur for the
offences punishable under Sections 302, 201, 143, 147, 148,
149, 120-B, 212 and 216 of the Indian Penal Code, 1860,
Sections 3 and 4 read with Section 25 and Section 27 of the
Arms Act, Section 135 of the Maharashtra Police Act, 1951
and Sections 3(1)(i), 3(1)(ii), 3(2) and 3(4) of the
Maharashtra Control of Organised Crime Act, 1999.

4. We are inclined to set aside the impugned order passed

Reason: by the High Court only on the premise that the appellant has
been under incarceration for about one year and seven
months. It is submitted by the learned counsel appearing for

the respondent-State that the charges were framed very
recently and the trial has just commenced and thus, is
likely to take some time to conclude.
5. Thus, notwithstanding that the appellant has two
criminal antecedents, we are inclined to set aside the
impugned order passed by the High Court and the same is
accordingly, set aside. We direct that the appellant be
released on bail subject to such terms and conditions that
may be imposed by the Trial Court. We make it clear that
the appellant shall cooperate with the conduct of the trial.
6. The appeal is, accordingly, allowed
7. Pending application(s), if any, shall stand disposed
of.
