Heard Mr. Mahendra Thakur, learned counsel for the

petitioner and the State.

2. The petitioner is in custody in connection with

Dumariya P.S. Case No. 35 of 2012 for the offence punishable

under sections 147, 148, 149, 341, 324, 353, 325, 326, 307, 302,

435, 120(B) of the Indian Penal Code and 27 of Arms Act and

Section 3, 4, 5 of Explosive Substance and Section 10, 11, 13(i),

13(ii) of U.A.P. Act.

3. As per the prosecution story, the informant alleged

that on information that the extremists have gathered near a hill,

Police reached there when mines explosion started which

followed indiscriminate firing. The Police men were injured, the

extremists ensured that another explosion take place which

resulted into the Jeep falling in the ditch causing injury to the
Patna High Court CR. MISC. No.49822 of 2025(2) dt.11-08-2025

Police persons. Later, the area was found and dead body of the

extremist was found along with the incriminating materials. This

led to the FIR.
