The complainant has filed the present complaint under
Section 200 of Cr.P.C. against the accused for the
commission of an offense punishable under section 138 of
Negotiable Instruments Act.

2. The case of the complainant in brief is as under:-

“The complainant and accused are known to each
other from few years. The accused assured to get company
of Vols Wagon Car to the complainant and for that reason
the complainant has transferred amount of Rs.40,000/- on
23.05.2018 and Rs.2 lakhs on 29.05.2018. Thereafter the
accused has not responding for the complainant. The
complainant has lodged complaint before the Vijaynagar
police station on 19.06.2018 and on that day the accused
had issued two cheques bearing No.785997 for Rs.50,000/-
and cheque bearing No.785994 for Rs.40,000/- drawn on
Karnataka Bank, Vijayanagar branch,Bengaluru. On

C.C.No.20589/2019

presentation of said cheque by the complainant through his
banker Syndicate Bank, P.G.Halli branch, Bengaluru same
has been returned as “Payment stopped by Drawer” on
15.11.2018.
