UPON hearing the counsel the Court made the following
O R D E R

1. The instant petition seeks release of the Petitioner
on bail in FIR bearing Case Crime No. 02/2024 dated 16.01.2024,
registered at Police Station Anti-Corruption Bureau/Economic
Offences Wing, Chhattisgarh, Raipur for the offences punishable
under Section 420 read with Section 120-B of the Indian Penal
Code, 1860 and under Sections 7 and 12 of the Prevention of

Corruption Act, 1988.

2. Titled the ‘District Mineral Fund scam,’ the
allegations in this FIR inter alia pertain to State Government
officials enabling inflated tenders, allowing illegal
gratifications to be funneled under the guise of material
procurement in Korba District of Chhattisgarh. The Petitioner
herein was the alleged ‘fund manager’ who would collect hefty
sums from the beneficiaries of these governmental contracts, for
and on behalf of the political authorities of the state. He was
consequently formally arrested on 03.03.2025, in connection with
the subject-FIR, while already being in custody in other cases.

3. Notably, the present Petitioner is also an accused in
an ED case alleging the perpetration of a ‘Coal Levy scam’ in
Chhattisgarh, namely PMLA-ECIR/RPZO/09/2022, registered on
29.09.2022 by the ED Raipur Zonal Office. He was arrested in
relation to this ECIR on 29.10.2022, and has been in custody ever
since. The Petitioner is similarly one of the principal accused
in FIR No. 03/2024 dated 17.01.2024, registered by the Anti-

Corruption Bureau/Economic Offences Wing, Raipur. Admittedly,
there are several co-accused named in all the aforementioned
criminal cases.

4. On 29.05.2025, this Court, after briefly hearing
counsel for the parties and considering the attenuating
circumstances coloring that batch of petitions, deemed it
appropriate to release the Petitioner as well as the various co-
accused on interim bail in numerous different FIRs and ECIRs. In
so far as the Petitioner and co-accused Ranu Sahu, Sameer Vishnoi
and Saumya Chaurasiya were concerned, this Court had also sought
fit to impose the following conditions on them while enlarging
them on interim bail:

“3. As far as the petitioners – Ranu Sahu, Suryakant
Tiwari, Sameer Vishnoi and Saumya Chaurasiya are
concerned, it is directed that they shall not stay in
the State of Chhattisgarh till further orders, except

that they shall remain present before the Investigating
Agency or the Trial Court as and when required. They are
also directed to furnish the addresses of their stay
outside the State of Chhattisgarh to the jurisdictional
police station within one week of their release.

4. In the event the petitioners are found to contact the
witnesses or influencing them in any manner or trying to
tamper with the evidence, the same shall be taken as a
misuse of concession of interim bail.

5. This interim arrangement is without prejudice to the
contentions of the respondent(s) and no equitable
consideration shall accrue in favour of the petitioners,
who are being released as an interim measure only, at
the time of further consideration of these matters.

6. The petitioners are directed to deposit their
passports before the Trial Court/Special Court
immediately on their release on interim bail.

7. The petitioners shall join the investigation and
fully cooperate with the same.”

5. We have heard learned Senior Counsel for the parties
at a considerable length, both for and against the grant of
interim bail to the Petitioner in the subject-FIR. After duly
considering their submissions and perusing the voluminous record,
we are of the opinion that in the instant case as well, the
Petitioner can be released on interim bail, at this stage. In all
fairness, we are not referring to the submissions made by both
sides, as such a holistic consideration is better deferred to the
stage of final hearing. However, it is clarified that here, too,
the Petitioner shall be bound by the conditions imposed by us in
our order dated 29.05.2025, reproduced above at para 4.

6. Ordered accordingly.

1. We have heard learned Senior Counsel for the parties
at a considerable length and perused the record.

2. We have duly considered the grounds urged for
recalling our order dated 29.05.2025 granting interim bail to
the Petitioner, namely Suryakant Tiwari. However, we find no
cogent reason for entertaining the present application at this
stage, and the same is accordingly dismissed.

3. However, it is open to the Prosecution to seek
cancellation of the interim bail if any material emerges
indicating misuse of the concession afore-granted.
