01. 1. Learned counsel for the petitioners submits that,
there is a typographical error in the prayer of the
petition in respect of the N.B.W. dated 19.11.2024. In
fact, the N.B.W. has been issued on 10.09.2008.
2. The petitioners have challenged the order dated
10.09.2008 passed in connection with Pipili P.S. Case
No.141 of 2003 corresponding to S.T. Case
No.138/185 of 2013/2005 corresponding to G.R.
Case No.230 of 2003 for the offences punishable
under Sections 452/ 325/ 323/ 294/ 506/ 307/
427/380/34 of the IPC, pending in the Court of the
learned Ad hoc Additional Sessions Judge, Puri, by
which the N.B.W. has been issued against them.

2. Learned counsel for the petitioners submits that
the petitioners were on bail, however, they could not
appear before the learned Court below leading to
issuance of the N.B.W. against them on 10.09.2008.
3. Learned counsel for the petitioners, on instruction,
submits that, the petitioners would surrender/appear
before the learned Court below on or before
31.01.2025 and seek remedy available to them under
law.
4. On the basis of the aforementioned facts and
submissions made at the Bar, the order dated
10.09.2008 passed in connection with Pipili P.S.
Case No.141 of 2003 corresponding to S.T. Case
No.138/185 of 2013/2005 corresponding to G.R.
Case No.230 of 2003, pending in the Court of the
learned Ad hoc Additional Sessions Judge, Puri, is set
aside, subject to the petitioners surrendering before
the Court below on or before 31.01.2025 and
depositing cost of Rs.1,000/- (Rupees one thousand)
each with the District Bar Association, Puri. Liberty is
granted to the petitioners to avail remedy under law
after surrendering as per the undertaking.
5. The CRLMC is accordingly disposed of.
