This complaint is filed under Sec. 200 of Cr. P. C.
for the offence punishable under Section 138 of the
Negotiable Instruments Act.
2. It is the case of the complainant that: The
complainant is a public limited company, carrying on
the business of providing various finance services. The
accused had requested for housing loan. The
complainant company had sanctioned the loan and the
accused agreed to repay the loan amount as per the
repayment schedule. The accused had entered into an
agreement bearing No.TCHHF0482000100072444.
Towards the repayment of the loan amount , the
accused has issued a cheque vide bearing No.000491
dated 23-12-2022 drawn on Karuru Vysya Bank for a
sum of Rs.90,69,273/-. The said cheque was presented
for encashment through the complainant bankers
HDFC Bank Ltd., Richmond road, Bangalore, the same
was returned with an endorsement ‘Account Closed’
dated 29-12-2022. Thereafter, the complainant got
issued legal notice to the accused on 18-01-2023. The
said legal notice, has intentionally deserted to receive
the registered post. The complainant has send online
Track consignment. As per the online track
consignment the said notice was served on 30-01-
2023. The accused has failed to repay the loan amount.
Accordingly, the accused has committed an offence
punishable under Sec.138 of N.I Act, hence, the
complaint.
