08/03/2025 undefined CONCILIATION ORDER 1] The applicant-original accused has filed the present
application for quashing and setting aside the order of conviction dated
07.08.2024 passed by the 3rd Additional District and Sessions Judge,
Mahesana in Criminal Appeal No. 105 of 2024 confirming the order
dated 06.02.2024 passed by learned 5th Additional Judicial Magistrate
Mahesana in Criminal Case No. 777 of 2023.
2] Learned advocate for the respondent No. 2- original complainant
has tendered the affidavit on behalf of the original complainant –
respondent No. 2 dated 4th March , 2025, which is taken on record and
requests the Lok Adalat to allow the present revision application.
3] Learned advocate for the applicant has submitted that the
respondent No. 2 has received Rs.7,18,000/- the disputed amount of
cheque and further submits that the complainant does not want to pursue
the litigation and the respondent No. 2 has no objection if the order
passed by both the Courts below be quashed and set aside. The
settlement affidavit to that effect has been filed by the complainant
without any undue pressure and coercion, influence.
4] Learned Additional Public Prosecutor appearing for the
respondent-State has submitted that the necessary orders may be passed.
5] Permission, as prayed for, is granted. In view of the affidavit of
settlement filed by the original complainant – respondent No. 2 submitted
by learned advocate for the appellant, this revision application stands
allowed in view of the affidavit of settlement of original respondent No. 2

original complainant and the impugned order dated 07.08.2024 passed by
the 3rd Additional District and Sessions Judge, Mahesana in Criminal
Appeal No. 105 of 2024 and the order dated 06.02.2024 passed by
learned 5th Additional Judicial Magistrate Mahesana in Criminal Case No.
777 of 2023 are hereby quashed and set aside.
Since the applicant is in Jail, the applicant may be released from
the concerned jail forthwith, if not required in any other case.
