Delay condoned.

Heard the learned counsel for the petitioner.

Learned counsel for the petitioner has also handed over,

across the bar, the copy of the policy which was issued in the name

of deceased Norden Sherpa who was driving the vehicle at the time

of the accident. After going through the judgment sought to be

challenged, we are of the view that the substantial justice meeted

out to the claimants warrant no interference. In short, we find no

compelling reason to interfere with the judgment sought to be

challenged, in exercise of the power under Article 136 of the

Constitution of India.

In the said circumstances, this special leave petition

stands dismissed.
