When this matter was called up for hearing, Mr. A. Kumar, learned
Advocate General appearing for the State petitioner has submitted at the bar
that it has come to his knowledge that a petition registered as WP(C) No. 176
of 2025 has been filed by one Shri. Bharat Prasad Singh and others before this
Court, the subject matter being the process of land acquisition of the land known
as Maxwelton Estate. The issues raised by the petitioners therein involves the
question of whether the relevant land acquisition proceedings have lapsed or
not vis-à-vis the application of the Land Acquisition Act, 1894 as well as the
new Act of 2013. Since the subject matter is also being questioned before this
Court in this instant petition, the learned Advocate General has submitted that
some time may be given to the parties to examine the same and to take necessary
steps in this regard so as to avoid conflict of decision, if any, before a coordinate
bench of this Court.

Mr. I. Borooah, learned counsel for the respondent has resisted the
submission made and has maintained that the subject matter of the said writ
petition has no connection with this instant petition filed before this Court, since
the dispute to be addressed in this petition is totally different from what has
been raised in the other writ petition. It is prayed that no cognizance be taken
of such submission.

This Court has considered the submission made and has been presented
with copy of the petition and relevant order dated 20.05.2025 passed in WP(C)
No. 176 of 2025. It is also noticed that the respondent herein, that is, Smti.
Krishna Borooah has not been made party in the said writ petition, perhaps for
this reason the learned counsel is not aware of the contents of the said writ
petition.

Be that as it may, since an informal copy of the said petition has been
handed over to the learned counsel for the respondent, he is requested to peruse
the same and to make his submission before this Court on the next date fixed.

As agreed to by the parties, list this matter for further hearing on
01.08.2025.
