[1] Heard Mr. N. Kumarjit, learned senior counsel assisted by

Mr. N. Zequeson, learned counsel for the applicant/writ petitioner.

[2] Issue notice in MC(WP(C)) No. 478 of 2025.

[3] Mr. A. Bheigya Meitei, learned junior Government counsel

assisting Mr. Y. Ashang, learned Government Advocate, accepts notice on

behalf of respondent Nos. 1 & 2 and Mr. S. Samungou, learned counsel,

accepts notice on behalf of respondent No. 3. None appears in the main

petition on behalf of respondent No. 4 in spite of service.

[4] By the present petition, the petitioner prays for stay of the

advertisement dated 03-07-2025 issued by respondent No. 4 for recruitment

of various teaching and non-teaching staff. Mr. N. Kumarjit, learned senior

counsel for the petitioner, submits that respondent No. 4 ought not to issue

the advertisement when his appointment as Principal is challenged in the

main petition and his term is going to expire on 3rd August, 2025. It is

submitted that the present application is for stay of recruiting teaching and

non-teaching staff and the fact that his appointment as Principal is sub judice

and illegal as he has already crossed the age of superannuation and prayed

that if the advertisement is not stayed, it will cause injustice.

[5] This Court is of the opinion that when the appointment of

respondent No. 4 as Principal is under challenge due to exceeding the age

of superannuation and other illegalities in terms of appointment, the

impugned advertisement should not be issued at all.

[6] Till the next date, the advertisement dated 03-07-2025 issued by

respondent No. 4 shall be kept suspended.

[7] List these cases on 23-07-2025. In the meantime, respondents

may file their replies.
