1. Application filed by the appellant under Section 34 of Arbitration and
Conciliation Act, 1996 for setting aside order dated 26.08.2023 passed by the
learned Arbitrator, Divisional Commissioner, Jammu came to be disposed of
by the Court of learned Principal District Judge, Reasi.
2. It appears that the dispute between the parties is in respect of
compensation for the land acquired under the National Highways Act, 1956,
which does not fall within the purview of Section 2(c) of Commercial Courts
Act, 2015, which defines commercial disputes, therefore, this matter is not
required to be considered by this Bench i.e. Commercial Appellate Division
Bench (Jammu Wing).
3. List this matter on 25.04.2025 before the learned Single Bench as per
roster.
