UPON hearing the counsel the Court made the following
O R D E R
1. Mr. Gaurav Agrawal, learned Senior Advocate appearing for the
petitioner places reliance upon the judgment in the case of Chandan
Banerjee and Ors. vs. Krishna Prosad Ghosh and Ors.[(2022) 15 SCC
453] to buttress the contention that the State, while formulating

2. He submits that in view of the ratio of the above judgment,
the view taken by the High Court is unsustainable in the eyes of
law.
3. Delay condoned. Issue notice, returnable in six weeks.
4. In the meantime, operation and effect of the impugned judgment
and order dated 09-07-2024 passed by the High Court for the State
of Telangana at Hyderabad in WP No. 14649/2017 shall remain stayed.
