Heard Mr.Th.Mahira, learned counsel for the petitioner
and Mr.S.Niranjan, learned PP for the State respondents.
The petitioner is aggrieved by the non-action of the
District Magistrate, Imphal East, in spite of the clear direction of the
learned Sessions Judge, vide order dated 4.6.2024 in Cril (Revision)
Case No.1 of 2023 for passing a fresh order on the pending application
being Cril (C) Case No.2 of 2022, filed under Section 133 Cr.P.C.
At this stage, Mr.Niranjan, learned PP, raised objection as
to the maintainability of the present writ petition as the petitioner is
seeking compliance of the order of learned Sessions Judge and not of
this Court.
In the circumstance, Mr.Mahira, learned counsel for the
petitioner submits that he may be permitted to withdraw the present
writ petition with liberty to approach the appropriate forum.
Recording the submissions made at the Bar and with
respect to the peculiar relief prayed for in the writ petition, the same is
dismissed as withdrawn, with liberty to approach the appropriate forum,
if so advised.
Furnish a copy of this order to learned counsel for the
parties.
