In the instant petition, petitioners herein, have sought exercise of
jurisdiction of this Court under Section 528 of BNSS of 2023, seeking
quashment of FIR No. 0021/2024 lodged by respondent No. 1 with the
connivance of respondent No. 2 against the petitioners at Police Station,
Basantgarh by virtue of which the petitioners have been implicated for the
commission of offence under Section 436/451/504/34 IPC. Learned counsel for
the petitioners states that there is already a civil dispute going on between the
parties, before the court of learned Sub-Judge Ramnagar, as such, respondents in
order to wreak vengeance, have lodged the instant FIR against the petitioners.
Issue notice to the respondents, returnable within four weeks for filing
objections. Requisite steps for service be taken within a week’s time.

Meanwhile, subject to objections from the other side and till next date of
hearing before the Bench, I.O. shall proceed with the investigation, however,
challan shall not be presented without the prior permission of this Court.
