              Criminal Petition No.6777 of 2025
Order:

     This Criminal Petition is filed by the petitioner/accused

No.2, seeking anticipatory bail under Section 482 of Bharatiya

Nagrik Suraksha Sanhita (BNSS), in connection with Crime

No.217 of 2025 on the file of Station House Officer,

Maheshwaram Police Station, Rangareddy District, registered

for the offences punishable under Section 318(4) of Bharatiya

Nyaya Sanhita, 2023 (BNS), Section 3 of the Essential

Commodities Act, 1955 (EC Act), Section 7 of the Seeds

Act, 1966 and Clauses 3(1) and 8(a) of the Seeds (Control)

Order, 1983 (SCO).


2.   Heard Mr. Sanjeeva Reddy Garlapati, learned counsel for

the petitioner/accused No.2 and Mr. Syed Yasar Mamoon,

learned   Additional Public Prosecutor appearing for the

respondent/State.

3. During the course of hearing, it is brought to the notice

of this Court that the offences leveled against the

petitioner/accused No.2 are punishable with an imprisonment

of less than seven years.

4. In view of the same, without going into the merits of the

case, this Court deems it appropriate to direct the

petitioner/accused No.2 to appear before the investigating

officer on or before 17.06.2025. On such appearance of the

petitioner/accused No.2, the investigating officer shall

scrupulously follow the procedure contemplated under

Section 35(3) of BNS and the guidelines issued by the Apex

Court in Arnesh Kumar Vs. State of Bihar 1.

5. It is made clear that the petitioner/accused No.2 shall

cooperate with the investigating officer for the investigation

and make himself available to the investigating officer as and

when required and also provide the information/documents as

sought by him to conclude the investigation.

6. If the petitioner/accused No.2 fails to cooperate with the

investigating officer for investigation, the investigating officer

is at liberty to take action against the petitioner/accused No.2

in accordance with law.

7. Subject to the above directions, the Criminal Petition is

disposed of. No costs.
