punishable under Sections 115(2), 351(2) and

Section 74 of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution story in brief, the

complainant appeared at Police Station Akaltara

and filed a report stating that on 08.05.2025 at

around 10:30 A.M., she had gone to the field to

collect cow dung. While she was collecting cow

dung, the present applicant approached her and

asked her to compromise regarding an old dispute.

When she refused, the applicant slapped her 3-4

times, dragged her by the hair to a nearby tree, and

started pulling her sari. Thereafter, she fled from the

scene and went to her house. Subsequently, Crime

No. 184/2025 was registered at Police Station

Akaltara for offences under Sections 115(2),

351(2), and 74 of the B.N.S., 2023, corresponding

to Sections 323, 506, and 354 of the Indian Penal

Code.

4. Learned counsel for the applicant submits the

present applicant and the complainant are

neighbors, and the complainant herself is

attempting to obstruct the entrance of the

applicant’s house. She is illegally constructing her

house on government land adjacent to the

applicant’s house. There has been a continuous

dispute between both families, and on 29.12.2022,

the present applicant lodged a complaint against

the complainant at Police Station This is the first

anticipatory bail application under Section 482 of the

Bhartiya Nagrik Suraksha Sanhita, 2023 (BNSS) filed

by the applicant, who is apprehending his arrest in

connection with Crime No. 92/2024 registered at

Police Station – Women Police Station, Bilaspur,

District – Bilaspur (C.G.) for the offence punishable

under Sections 3(5), 85, 115(2), 296 and Section

351(3) of the Bhartiya Nyaya Sanhita, 2023. Akaltara

and the present FIR has been lodged on bald

allegations as a counter blast, therefore, he prays

for the grant of anticipatory bail to the applicant.

5. On the other hand, learned State counsel prays for

some time to proved the copy of the statement of

the victim recorded under Section 183 of the BNSS.

6. Considering the facts and circumstances of the

case, purely as an interim measure, it is directed

that the applicant shall not be arrested in Crime No.

184/2025, registered at Police Station Akltara,

District Janjgir – Champa, for offence punishable

under Sections 115(2), 351(2) and 74 of the

Bhartiya Nyaya Sanhita, 2023 till the next date of

hearing .

7. Let the matter be listed again in the next week to

enable the learned State counsel to proved a copy

of the statement of the victim recorded under

Section 183 of the BNSS.
