This appeal challenges the order dated 04.04.2025
passed by the High Court of Judicature at Patna in
Criminal Miscellaneous No.87509 of 2024.
This appeal arises out of crime registered
pursuant to FIR No.36 of 2023 dated 02.08.2023 lodged
with Police Station Sub Division Sadar, District
Aurangabad, Bihar, registered under Sections 323, 341,
504, 506 and 498-A read with Section 34 of the Indian
Penal Code, 1860 (for short ‘IPC’) as well as Sections
3 and 4 of the Dowry Prohibition Act, 1961 (for short
‘DP Act’). Apprehending arrest in connection with the
said crime, the appellant preferred anticipatory bail

Said application for anticipatory bail having
been rejected by order dated 03.11.2023, the appellant
preferred another anticipatory bail application C.I.S.
Reg. No. 2136/2024 before the same court, which was
again rejected by order dated 16.11.2024.
Thereafter, the appellant sought anticipatory
bail before the High Court. By impugned order dated
04.04.2025, the High Court also rejected the plea for
anticipatory bail. Therefore, the instant appeal has
been preferred.
By order dated 26.05.2025, while issuing notice,
this Court granted interim protection in favour of the
appellant.
We have heard learned counsel in support of the
appellant and learned counsel for the respondent-
State.
Learned counsel for the appellant submitted that
the appellant’s son was married to the informant and
subsequently, there has been a dissolution of the
marriage between them; that the allegations as against
the appellant herein are wholly frivolous. The
appellant is seeking relief on the principle of parity

since his wife and daughter have been granted the
relief of anticipatory bail. Therefore, he submitted
that the interim protection granted by this Court vide
interim order dated 26.05.2025 may be made absolute,
subject to the terms and conditions to be imposed by
this Court.
Per contra, learned counsel for the respondent-
State with reference to her counter affidavit
contended that there is no merit in this appeal; that
the appellant has other criminal antecedents which are
on similar allegations.
Considering the circumstances on record, in our
view, the appellant is entitled to the relief of
anticipatory bail claimed.
We, therefore, allow this appeal and set aside
the order passed by the High Court of Judicature at
Patna dated 04.04.2025. We direct that in the event of
arrest of the appellant, the Arresting Officer shall
release the appellant on bail, subject to furnishing
cash security in the sum of Rs.25,000/- (Rupees
Twenty-Five Thousand only) with two like sureties.
It is directed that the appellant shall extend
complete cooperation in the ensuing investigation.

The appellant shall not misuse his liberty and
shall not in any way influence the witnesses or tamper
with the material on record.
With the aforesaid directions, the Criminal
Appeal is allowed.
