3. This appeal, preferred under and in terms of Order XLIII Rule 1(d) of the
Code of Civil Procedure (CPC), is directed against Order dated 1st July 2024
passed by the court of Additional District Judge, Handwara (Trial Court) in
a case titled as Collector Land Acquisition and another v. Inhabitants of
Braripora.

5. The case set up by appellants is that land measuring about 72 Kanals 17
Marlas situate at Braripora Tehsil Handwara was acquired for construction

of Sports Stadium. Landowners resisted fixation of rate of the land, so
Additional Deputy Commissioner, Handwara, vide letter no.ADC/LA/14/
443 dated 18th October 2014 made reference under Section 18 of J&K Land
Acquisition Act to Principal District & Sessions Judge, Kupwara.
