1. Impugned in this judgment filed by the Union Territory of
Jammu and Kashmir and two others, is an order and judgment dated 7 th of
June, 2024 passed by the Central Administrative Tribunal, Jammu Bench,
Jammu (the tribunal) in TA No. 61/344/2020 titled as “Prem Nath vs
State of Jammu & Kashmir & Ors.”, whereby the tribunal has allowed
the application of the respondent with the following directions:
“18. In view of the above, we dispose of this T.A. with the
following directions:-
2 WP(C) No. 3090/2024
(i) the impugned communication dated 19.01.2006
of Respondent No. 2, whereby the applicant was retired from
service, besides effecting recovery from him with interest is
quashed and set aside.
