3. The present petition is filed to
quash the supplementary charge sheet
dated 26.09.2016, the summoning order
dated 23.03.2017 passed by the learned
ACJM, Haridwar in Criminal Case No.
429 of 2017 (State vs. Bhawani Dutt
Bhatt
) under Sections 420, 467, 468,
471, 120-B, 147, 323, 504, and 506 IPC,
as well as the entire criminal
proceedings.

4. Learned counsel for the applicant
would submit that the matter arises out
of internal disputes in the Jawahar Lal
Nehru National Youth Centre, a
registered society; that the applicant,
appointed as State President, was
involved in restructuring the committee,
which led to a civil dispute with Smt.
Deepa Joshi. Her husband’s earlier
complaint under Section 156(3) Cr.P.C.
was rejected and the revision dismissed;
a civil suit was also filed by her.

5. It is alleged that the FIR was
lodged by respondent no.4 at the behest
of Smt. Deepa Joshi and her husband, to
give a civil dispute a criminal colour.
The applicant, not named in the original
charge sheet, was later included in the
supplementary charge sheet without
proper material or judicial application of
mind.

6. Learned counsel for the applicant
would submit that the summoning order
is unsustainable, and a non-bailable
warrant issued on 24.07.2025 should be
kept in abeyance.

7. Learned State counsel would
oppose the petition but admits that the
applicant’s name appears only in the
supplementary charge sheet and that a
non-bailable warrant has been issued.

8. A perusal of the record reveals
that, vide order dated 10.08.2017, a
Coordinate Bench of this Court had
granted liberty to the applicant to move
an application for adjournment before
the trial court.

9. Having heard learned counsel for
the parties and upon perusal of the
material on record, it is directed that the
non-bailable warrant issued against the
applicant in Criminal Case No. 429 of
2017 (State vs. Bhawani Dutt Bhatt),
pending before the learned Additional
Chief Judicial Magistrate, Haridwar,
shall remain in abeyance till the next
date of listing.

10. List this case on 12.09.2025.

11. Interim order, if any, earlier
granted shall continue till the next date
of listing.
