The Court: This is an application for additional evidence under Order

XXXXI Rule 27of the Code of Civil Procedure, 1908.

It is submitted on behalf of the appellant that certain orders and

documents which were not available at the relevant point of time subsequent to

the filing of the instant appeal have come to light and the appellant intends to

rely on them.

The appellant is represented and does not object to the prayer made on

behalf of the respondent.

In view of the above, there are sufficient reasons as to why the additional

evidence sought to be relied on by the respondent are necessary for effective

adjudication of the present disputes and could not be adduced despite due

diligence.

Accordingly, there shall be an order in terms of prayer (a) of the

Notice of Motion.

With the above directions, IA NO.GA-COM/1/2025 stands disposed of.

The parties are directed to comply with necessary formalities.

Let this matter appear for further hearing on 19th February, 2025.

As prayed for by the parties, liberty is also granted for filing of their

respective notes of arguments.
