Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed herein, the High Court may be pleased to
issue a Writ or order or direction, more particularly one in the nature of Writ of
Mandamus, declaring the high handed action of the respondents in threatening to
demolish the shops of the petitioner society bearing H.No. 7-27/1 situated at Bharath
Nagar, Uppal, Hyderabad without considering the explanation and the enclosed
documents in pursuance of the impugned Notice No.TP/UC/25/Cr2/GHMC/2013
dated: 07.01.2014 U/Sec. 636 of GHMC Act, issued by the 3rd respondent as bad,
arbitrary, illegal, unjust and against the Principles of natural Justice and
consequently direct the respondents not to interfere with the peaceful possession
and enjoyment of the petitioner society and its members in respect of the premises
bearing No. 7-27/1 situated at Bharath Nagar, Uppal, Hyderabad.
WPMP.NO. 3118 OF 2014:
Petition under Section 151 of C.P.C., praying that in the circumstances
stated in the affidavit filed in the Writ Petition, the High Court may be pleased
to stay of demolition of the premises bearing No. 7-27/1 situated at Bharath
Nagar, Uppal, Hyderabad of the petitioner society in pursuance of the
impugned Notice No. TP/UC/25/Cr2/GHMC/2013 dated 07.01.2014 U/Sec.
636 of GHMC Act issued by the 3rd respondent, pending disposal of WP. No.
2552 of 2014 on the file of the High Court.
The petition coming on for hearing, upon perusing the petition and the affidavit
filed herein and upon hearing the arguments of Sri A. Vishnuvardhan Reddy,
Advocate for the Petitioner, and Sri C. Damodar Reddy, Learned Standing Counsel
for the GHMC for the Respondents, the Court made the following

ORDER:
“Sri A.Vishnuvardhan Reddy, Learned Counsel for the petitioner, draws
attention of this Court to the proceedings of the Executive Officer,
Grampanchayat, Uppal Kalan, Hyderabad, dated 11.10.1971 and 23.12.1986
in support of his submission that permission was accorded to the petitioner
for construction of the subject premises. Learned Counsel would further state
that for replacing the old tin roof with new tin roof and for white washing the
building, no permission is required.
Sri C.Damodar Reddy, Learned Standing Counsel seeks time to obtain
instructions.
Post on 07.02.2014 in the motion list.
Status quo as on today in all respects shall be maintained for a period of
10 (Ten) days.”
